We are a Private Membership Association (PMA) and only does business with its Private Members. I understand that I am being granted temporary membership status from my information and education purposes to decide if I do want to become a Private Member of this PMA. I further understand that if I do choose to become a Private Member to conduct and transact any private business, I do so voluntarily and not in the capacity of any public agent or investigator, as that would be a understood violation of private civil rights and all such persons are subject to the Bivens decision, which means they must identify themselves prior to participation in any The Wellness Diagnostics and Medispa PMA activity…
See Bivens v. Federal Agents, 403 U.S. 388 (1971). Since then, the Supreme Court has recognized a Bivens action in two other contexts:
1. in violation of the 5th Amendment, Davis v. Passman, 442 U.S. 228 (1979),
2. in violation of the 8th Amendment, Carlson v. Green, 446 U.S. 14 (1980).
